Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Discussions

7:30 PM  Don Ellis inquired of the Board that if, before the haybales are put down, he could cut down two pine trees at Union Street to gain access to the property.  They are outside the 50-foot buffer and he will leave the stumps.  (DEP #175-369)

Public Hearings   

7:45 PM  Request for Determination of Applicability for construction of a 12’ x 25’ deck at 708 West Washington St., Map 75, Lot 18A for owners Jonathan & Kathleen Bizier. (New Hearing)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   The Biziers obtained a Building Permit to put a second floor on which was completed.  Their original plan called for a 4’x6’ deck off the back of the house.  They want to increase the size of the deck.  The construction of said deck will call for 10 footings.  Haybales and a silt fence had already been installed along the brook for driveway construction.   A site inspection is needed for the Board to make a decision.

8:00 PM  Abbreviated Notice of Resource Area Delineation to determine the accuracy of the wetland line at 162 Industrial Blvd., Assessor’s Map 59, Lots 17-7 & 17-8 for J & G Mgmt. LLC represented by Coneco Engineers & Scientists, 4 First St., Bridgewater, MA  02324

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Joseph Harnois, P.E. of Coneco Engineers made a presentation and presented a revised plan showing a change in the location of one flag.  Mr. Lindquist read Ms. Cassady’s site report and it is her recommendation that the Commission inspect the wetland line as it is questionable in areas.

8:15 PM   Abbreviated Notice of Resource Area Delineation to determine the accuracy of the wetland line at 684 Pleasant St., Assessor’s Map 8, Lot for Victor Lewis, 231 Brook St., Hanson, MA represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #175-429)  (New Hearing)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  John Peckham of Land Planning made the presentation.  Sharon LePorte delineated the Bordering Vegetated Wetland.  Mr. Lindquist read the agent’s site report.  It is Ms. Cassady’s opinion that the wetland line is accurate.  She and Ron Grattan investigated the possibility of vernal pools on the property.  However, the ponded areas that are present are interconnected with a man-made ditch system and vernal pools cannot have an inlet or outlet.  Mr. Nicholson read the abutters list.  Those present were:

Stephen Masciovecchio, 670 Pleasant St.:  Mr. Masciovecchio asked how the wetland line was determined. Mr. Lindquist informed him that vegetation and sometimes soil samples are used.

8:30 PM  Continued Notice of Intent for construction of a 19,200 SF contractor’s building and yard with associated grading, driveway and detention basin as well as filling approx. 2,732 SF of wetlands with a replication of 4,198 SF as shown on the site plan at Industrial Blvd., Assessor’s Map 67, Lot 17-13, for West Hanover Strawberry Hill, LLC, 1401 Hanover St., Hanover, MA represented by Merrill Assoc., Inc., 427 Columbia Rd., Hanover, MA  (DEP#175-426)

Doug Schroeder of Merrill Associates presented a revised plan showing additional parking spaces as well as revised drainage calculations.   A drive was added in the back of the building to be used for storage.  At the agent’s request, they have also removed the replication area from the plans because of a vernal pool that was discovered on the property.  Mr. Grattan had a concern as to what would be stored behind the building.   Mr. Schroeder replied that no hazardous materials would be stored.  Mr. Lindquist had drainage concerns, especially with one particular basin at the mouth of the driveway.   Ms. Gardner feels a new variance letter is required to reflect the changes in the plan and to request work within the 50-foot no disturb zone (driveway).

8:45 PM Continued Notice of Intent for construction of a roadway, a residential dwelling including utilities, associated site-work and paving at Pine Grove Ave. & Fallon Point Rd., Assessor’s Map 69, Lots 3H-2 & 3H-3 for Kevin Johnson, 86 Pine Grove Ave. represented by P.M.P. Assoc., LLC of 200 N. Bedford St., E. Bridgewater, MA  (DEP #175-)   

David Johnson of P.M.P. Associates presented revised plans showing a change in the design and location of the house.   The size of the house had been reduced and moved to avoid grading within the 50-foot no disturb zone.   Also, he presented a request for variance to do pre-construction clean-up work in an area with dead trees and debris.  All work will be done by hand.   There was much discussion over a drainage pipe that was observed by the agent to be connected to a wetland area on Maquan Street and draining towards the property in question.   The proposal calls for a right angle being added to the pipe and directed towards a drain manhole.

Enforcement

Phil Lindquist read off the list of violations that have occurred recently at various properties around town and have warranted violation notices.  They are, in no particular order:

559 Liberty Street, owner Phil Huntley - non-compliance of riverfront restoration
Hanson Rod & Gun Club  - anonymous complaints of trucks going in and out
480 East Washington Street, owner Dan Rosman  - siltation/haybales have deteriorated
92 Pleasant Street, owners John Cannon & Annie Hinchey – tree cutting in 50-foot buffer

Colonial Heights-Valley Forge Road – Clearing of lot within the 50-foot no disturb zone without a permit.  Ms. Cassady suggests issuing an Enforcement Order to owner Roy Vinton.

Lot 5 Ransom Road - Clear Cutting in the 100-foot buffer zone and damage to the wetland areas.  Ms. Cassady has suggested an Enforcement Order to cease and desist to owner Jon Ridder. Ms. Gardner would like Mr. Ridder to make an appointment for the June 8th meeting to resolve the violations or possibly incur fines beginning June 9th, 2004.
